1. Agreement to these terms
These terms govern your use of nexacodex.com and any services you engage Nexa Codex ("we", "us") to provide, such as website design, app development, SEO, or related digital services. By using this site or engaging us for work, you agree to these terms.
2. Services and quotes
Any pricing shown on this site (including on our Pricing page) is indicative and subject to a final scope confirmed in writing before work begins. Actual project cost, timeline, and deliverables are agreed in a separate proposal, quote, or contract specific to your project.
3. Client responsibilities
To deliver work on schedule, we rely on clients to provide requested content, feedback, approvals, and access (e.g. hosting or domain credentials) in a timely manner. Delays in providing these may extend project timelines correspondingly.
4. Payments
Payment terms (deposit, milestones, final payment) are set out in your individual project agreement. Late payment may result in paused work until accounts are settled.
5. Intellectual property
Unless otherwise agreed in writing, ownership of final deliverables (code, designs, content we create for you) transfers to the client upon full payment. We retain the right to showcase completed work in our portfolio unless you request otherwise in writing.
6. Third-party tools and services
Some deliverables may depend on third-party platforms (hosting providers, domain registrars, APIs, analytics tools). We are not responsible for outages, pricing changes, or policy changes made by those third parties.
7. Limitation of liability
We aim to deliver reliable, well-tested work, but we do not guarantee specific business outcomes (such as search engine rankings, traffic, or sales) as these depend on factors outside our control. To the extent permitted by law, our liability for any claim relating to our services is limited to the fees paid for the specific service in question.
8. Termination
Either party may terminate an ongoing engagement per the notice terms in the individual project agreement. Work completed up to the termination date is payable.
9. Governing law
These terms are governed by the laws of India, and any disputes are subject to the jurisdiction of the courts in Chhatrapati Sambhaji Nagar (Aurangabad), Maharashtra, unless otherwise agreed in a specific contract.
